Welcome to Actura Agency LLC. By purchasing our services, accessing our platform, or checking the agreement box at checkout, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
1. Services
Actura Agency LLC provides website design, marketing automation, CRM setup, reputation management, SEO, and related digital services for home service businesses. The specific services included in your plan will be outlined at the time of purchase.
Actura Agency LLC reserves the right to modify, update, or discontinue any feature or service at any time with reasonable notice.
2. Subscription and Billing
Our services are offered on a month-to-month subscription basis. All subscription fees are billed in advance of the service period and are automatically renewed each month until canceled.
Payment is collected via credit or debit card through our secure payment processor. By providing your payment information, you authorize Actura Agency LLC to charge your card on a recurring monthly basis.
Pricing is subject to change. You will be notified of any pricing changes in advance of your next billing cycle.
3. No Refund Policy
All payments made to Actura Agency LLC are final and non-refundable, including subscription fees and any usage-based charges. By signing up for our services, you acknowledge that our products are custom-built, immediately initiated, and non-reversible once delivery begins.
If you have concerns about a charge, please contact us directly at support@acturaagency.com before initiating any dispute.
4. Chargebacks
You agree not to initiate a chargeback or payment dispute for services rendered. Doing so constitutes a violation of this agreement.
In the event of a fraudulent chargeback, Actura Agency LLC reserves the right to submit evidence of contract acceptance, platform usage, and service delivery in response to the dispute, and may pursue recovery of the amount owed plus any associated legal or collection fees.
5. Cancellation
You may cancel your subscription at any time by contacting us at support@acturaagency.com. Cancellation becomes effective at the end of your current billing cycle. No future charges will be made after cancellation takes effect.
Cancellation does not entitle you to a refund for any portion of the current billing period already paid.
6. Delivery of Services
Services are considered rendered and fulfilled once:
- The client’s website has been completed and delivered
- Platform and automation setup has been finalized
Onboarding support and login assistance may be provided as a courtesy but are not a prerequisite for fulfillment. Access to the completed platform constitutes delivery of services.
7. Client Responsibilities
To allow Actura Agency LLC to deliver services in a timely manner, you agree to:
- Provide all required business information, logos, photos, and content within 7 business days of signing up
- Provide necessary login credentials or access to existing platforms when required
- Respond to communications from our team in a timely manner
- Review and approve deliverables within a reasonable timeframe
Actura Agency LLC is not responsible for delays in delivery caused by a client’s failure to provide required materials or approvals. Delays caused by the client do not affect billing.
8. Payment Failures and Service Suspension
If a payment fails, we will attempt to process the payment up to 4 times over a 3-week period. If the balance remains unpaid, your account and platform access may be suspended until the outstanding balance is resolved.
Actura Agency LLC reserves the right to permanently terminate accounts with repeated payment failures.
9. SMS Communications
By providing your phone number and opting in, you agree to receive SMS/text messages from Actura Agency LLC related to your account, service updates, and communications. Message and data rates may apply. Message frequency varies.

Your mobile opt-in information will not be shared with third parties for marketing purposes.
10. Intellectual Property
All content, branding, platform features, and materials created by Actura Agency LLC remain the intellectual property of Actura Agency LLC until full payment has been received. Upon completion of payment obligations, website content and creative assets specific to your business will be considered your property.
You grant Actura Agency LLC the right to use your business name, logo, and website as a portfolio reference and case study unless you request otherwise in writing.
11. Limitation of Liability
Actura Agency LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the amount paid by you in the 30 days prior to the claim.
12. Changes to These Terms
Actura Agency LLC reserves the right to update these Terms of Service at any time. Changes will be communicated via email or posted on our website. Continued use of our services after changes are posted constitutes your acceptance of the updated terms.
13. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
